Disability Leave by Reason of Pregnancy for Academic and Non-Academic Staff Members

The General Rules and The Policy and Rules-Nonacademic provide that a disability leave may be taken by both academic and nonacademic staff members for reason of pregnancy.

For faculty members and academic administrative staff, disability leave by reason of pregnancy is granted according to University of Illinois General Rules relating to disability leave for academic staff members. For nonacademic staff, maternity leave is granted according to University of Illinois Policy and Rules-Nonacademic relating to disability benefits for pregnant nonacademic staff members.

  1. Academic Faculty and Administrative Staff Policy

    Disability leave by reason of pregnancy is granted according to University of Illinois General Rules relating to disability leave for academic staff members. Such leaves are granted by the departmental executive officer for a period in which the staff member's pregnancy prohibits the performance of regularly scheduled duties as determined by an acceptable medical opinion.

    In addition, (1) A staff member is eligible for extended disability leave of twelve work days with full pay for each year of service, including the first, the unused portion of which is cumulative in any year to a maximum of 240 work days. (2) Noncumulative leave is granted with full pay for disability in each year of service, including the first, of 13 work days. In the event the 25 days of earned disability leave described above are exhausted in an appointment year, any balance of leave accumulated after January 1, 1984 will be available for use. After that amount is completely depleted, any balance of disability leave accumulated prior to January 1, 1984 may be used.

    After an academic staff member has exhausted all of the above sick leave, subject to the approval of the President or Chancellor as appropriate, a staff member who has completed at least three full years of service may be granted a disability leave with full pay for a period (including the annual and extended leaves and accumulations described above) not to exceed one-half of the staff member's appointment year.

    No deduction of time from the annual leave or the extended leave is made if the member is ill or disabled at a time when that staff member is not expected to furnish regular service to the University. After the disability benefits described above have been exhausted, a member may be granted a disability leave without pay from the University. If such a member is a participant in the State Universities Retirement System of Illinois, that member may apply for the benefits to which he or she is entitled under that System.

    For purposes of this subsection (2), disability includes cases in which the staff member is disabled from performance of duty by reason of pregnancy.

    A staff member who has not accumulated sufficient disability leave and who has not completed three full years of service to the University to be eligible for disability leave up to one-half of the appointment year may, by approval of the Chancellor, utilize accumulated and unused vacation and/or request leave without pay sufficient to cover the time necessary for the leave. (The approval of the Office of the Chancellor must be obtained only when it is necessary to request extended leave under the provision in the disability leave policy and/or to request leave without pay.)

    When an employee resumes work after disability leave by reason of pregnancy, it is expected that she will be accorded the return rights equivalent to those provided for persons returning from leaves because of other kinds of disabilities.
